Identity of the Data Controller

As Private Esteveraclinic Company For Health Services (hereinafter referred to as Vera Clinic), we have prepared this Clarification Text in order to tell you which personal data we will process for what purposes. Your personal data stated below under all circumstances;

• In accordance with the law and honesty rules,
• By maintaining the accuracy of the personal data you have shared and the most up-to-date state as you inform us,
• For specific, explicit and lawful purposes,
• To be related, limited and measured with the purpose of processing,
• We inform you that we will keep it for the period stipulated in the relevant legislation or required for the purpose for which they are processed.

Your Processed Personal Data
Personal data regarding employees provided to us by them can be processed by us. Your personal data that may be subject to processing are as follows:

Data Collection Method and Legal Reason

As Vera Clinic, we callect data that we have requested from you personally during your job application, through the application form or other platforms, or from your resume (which you choose to share) or in other texts you share regarding your application, by your physical or electronic transmission to us. The purposes of this collection is to fulfill our legal obligations, the performance of the employment contract between us, or for the reasons stipulated by the law and for the legitimate interest of Vera Clinic. In accordance with Vera Clinic’s legal obligation and legitimate interest to ensure security, we collect images through our security cameras.
In order to fulfill our legal obligation and due to the stipulation of the laws, we collect your personal data physically and electronically through our workplace physician in order to ensure workplace safety.
We collect it through legal documents and notifications that are sent to us to fulfill our legal obligations.

Purposes of Processing Your Personal Data

Your personal data is processed by Vera Clinic for the following purposes and legal reasons.
Fulfilling the purpose required for the performance of the employment contract, in particular;

• Leave approval of employees, viewing of remaining leaves, making vacation arrangements
• Dismissal of employees
• Ensuring that payroll transactions are carried out
• Making salary payments to employees

In order to fulfill the requirements within the scope of Labor Law, Occupational Health and Safety Law, Social Security Law and related legislation, other laws and legislation, in particular;

• Creation of personnel personal file
• SSI notifications, İŞKUR notifications, police station notification, incentives and legal obligation notifications
• Ensuring the opening of a compulsory private pension insurance account
• Control of employees’ entry and exit records
• Paying the salary foreclosures of employees to enforcement files
• Legal notifications of work accident
• Occupational health and safety procedures
• To comply with other information storage, reporting and information obligations stipulated by the legislation, relevant regulatory institutions and other authorities
• Execution of court decisions

In order to ensure safety in Vera Clinic, especially;

• Ensuring workplace safety
• Providing entrance and exit of the employee to Vera Clinic

For the administration of Vera Clinic, the execution of the business, for the implementation of Vera Clinic policies, in particular;

• Making expense payments to employees
• Communication with employees
• Providing vehicles to the employee and arranging parking spaces
• Providing business card printing
• Ensuring that packages received by cargo and courier are delivered to the relevant employee
• Monitoring the use of the Vera Clinic vehicle for the safety of the employees and the execution of the business
• Providing service and travel organization
• Creating the employee’s work e-mail by entering employee data in Mail Programs
• Ensuring control of employees’ entry and exit to work
• Monitoring the daily work performance of employees
• Recording the employees’ documents collected during the job application and interview
• Providing congratulatory communication
• Trainings’ planning and reporting, preparing training certificates, tracking employees participating in trainings, tracking development processes as a result of the trainings received by employees
• Communicating with relevant people in emergency situations

Your personal data will be kept for the maximum period specified in the relevant legislation or required for the purpose for which they are processed, and in any case, for the legal time-out period.

Sharing your Personal Data with domestic third parties

Your personal data may be shared with public entities for your security and the fulfillment of Vera Clinic’s obligations against the law, Labor Law, Occupational Health and Safety Law, Social Insurance and General Health Insurance Law, the Law on the Regulation of Publications on the Internet and the Fight Against Crimes Committed Through These Publications. These public entities may be Turkish Relevant institutions or organizations to the extent permitted and required by the provisions of the Commercial Code, Personal Data Protection Law No.6698, Identity Notification Law and legislation provisions; Personal Data Protection Authority, Ministry of Finance, Customs and Trade, Ministry of Labor and Social Security Ministry, Turkey Business Association (İş-Kur), Information and Communication Technologies Authority.

In addition, your personal data can be shared following these puposes:

Fulfilling the purpose required for the performance of the employment contract, in particular;

• We can process it in the accounting program in order to carry out payroll transactions and to update the relevant data. These data are stored in the application’s own data recording medium.

In order to fulfill the requirements within the scope of Labor Law, Occupational Health and Safety Law, Social Security Law and related legislation, other laws and legislation, in particular;

• We can share them with the consultancy firms and private employment agencies we work with in order to obtain consultancy on the determination and calculation of incentives.
• We can share your health data with our workplace doctor so that they can perform treatment and health checks.
• We are able to transfer payroll information to Vera Clinic auditors so that they can perform their audit activities.

Fulfilling our legal obligations, especially;

• In order to exercise our right of defense, we can be shared with our lawyers and relevant institutions within the framework of our obligation to fulfill legal requests such as court orders or evidence requests, provided that it is in accordance with the law and procedure.

For the administration of Vera Clinic, the execution of the business, for the implementation of Vera Clinic policies, in particular;

• Required personal data can be transferred to the company we work with for reasons such as transportation, reservation, vehicle supply, visa services, business card printing, parking lot registration.

Sharing your Personal Data with 3rd parties abroad

If you give your consent, your personal data can be shared with third parties abroad for communication, travel organization and training abroad.

Your Rights

Within the scope of KVKK, you have the following rights regarding your personal data:

• request information about whether your personal data is processed,
• learn the purpose of processing and whether they are used for that same purpose (if it has been processed)
• know the third parties to whom your personal data is transferred,
• request correction if your data is processed incorrectly or is incomplete
• request the deletion or destruction of your personal data if the reasons requiring processing are eliminated,
• request notification of these transactions to third parties to whom your personal data is transferred,
• to object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
• If you suffer damage due to unlawful processing of personal data, you have the right to demand compensation for the damage.

In the application containing your explanations regarding the right you have as a personal data owner and that you will make to benefit from your rights stated above and that you request to use; The subject you request must be clear and understandable, the subject you request is related to you in person, or if you are acting on behalf of someone else, you must be specially authorized and document your authorization, the application must contain identity and address information, and documents certifying your identity must be attached to the application.

Your applications within this scope will be finalized as soon as possible and within 30 days at the latest. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged. If the answer to the application is given in a recording medium such as CD or flash memory, the fee that may be requested by Vera Clinic cannot exceed the cost of the recording medium.
